So, you would think that if you bought a music CD, you should be free to burn in to your IPOD, right? Apparently, the RIAA does not agree.
I found this article at the Electronic Frontier Foundation website:

Apparently not.
As part of the on-going DMCA rule-making proceedings, the RIAA and other copyright industry associations submitted a filing that included this gem as part of their argument that space-shifting and format-shifting do not count as noninfringing uses, even when you are talking about making copies of your own CDs:
"Nor does the fact that permission to make a copy in particular circumstances is often or even routinely granted, necessarily establish that the copying is a fair use when the copyright owner withholds that authorization. In this regard, the statement attributed to counsel for copyright owners in the MGM v. Grokster case is simply a statement about authorization, not about fair use."
For those who may not remember, here's what Don Verrilli said to the Supreme Court last year:
"The record companies, my clients, have said, for some time now, and it's been on their website for some time now, that it's perfectly lawful to take a CD that you've purchased, upload it onto your computer, put it onto your iPod."
If I understand what the RIAA is saying, "perfectly lawful" means "lawful until we change our mind." So your ability to continue to make copies of your own CDs on your own iPod is entirely a matter of their sufferance. What about all the indie label CDs? Do you have to ask each of them for permission before ripping your CDs? And what about all the major label artists who control their own copyrights? Do we all need to ask them, as well?
P.S.: The same filing also had this to say: "Similarly, creating a back-up copy of a music CD is not a non-infringing use...." | |

I think all this is just rubbish, the law is getting out of hand, not just on CDs but everything, now-a-days you can sue anybody for anything I think its pathetic. Im going to sue Garner for using a web address I might have wanted at some point in my life.
Im going to sue NCF for not being in a Clan. etc...
I buy CDs, simply because I lik owning the original and the Proper version, However I have ripped most of my music collection from CD, to a ATRAC Cd, which is a compiled CD, basically like MP3 but smaller, reason I have done this? My SONY CD player supports ATRAC. |

Heh the law is stupid anyway when it comes to that stuff. weather or not im allowed to do something wont stop me 
Infact im gonna buy a ipod now just to do that 
I got a alternative to itunes on my laptop for when my mates with ipods come round to get some stuff. |

I myself buy CDs for the same reasons (I like the aesthetics); but when I spend $250+ on an ipod, you can bet I'm going to put my CDs on it. The majority of my ipod is music from CDs I own and the rest are songs purchased off itunes, but 3/4 of my ipod (Which is almost full) are songs from CDs that I PURCHASED AND OWN and refuse to buy again. |

Heh, i take it you ( like beatonator) are on 56k. fair enough if your not... but i dont know many people that dont download music.
I buy some cds... but im pretty skint at the moment so i dont buy as many as id like to..
Oh and hit person. Nice bruce CENSORED inson picture thats from accident of birth isnt it?

Not on 56k, i'm just a sucker for those purdy pictures on the the CD cases and booklets.

Generally I could think that RIAA could be held responsible for new european copyright laws, as it looks like that it is afterall behind of everything. Very annoying.
I do not buy music on CDs because I do not have enough of money for that, even I would have, I would not be interested on CDs what has things like "root kit" and other crap.
Also I am defending my one of my very basic rights all the time, individual's freedom of speech in finland (and I do mean that new finnish copyright law forbids to speak about howto go around copyprotections etc.) But I could not care for less.
Anyway for my luck I got nice things like silcy and compusec etc... |

Just for that. I'm never going to buy a CD. I'll stick to what I do now. Buy only the songs I like. What's the point in having a CD version of it. I mean who here still listens to CDs.

I buy CDs then rip em onto my PC... then transfer em onto my MP3 player (Which is NOT an iPod. iPods aren't the only MP3 players out there... I told you!) and listen to the music from that! It's also nice to have it on the PC so I can listen when I'm whipping noobs at COD2.
Edit: Coincidentally, I was just out whipping some noobs with a rifle when a bunch of idiots joined and started using the PPSh! (If you don't play COD2, it's basically the HMG, high rate of fire, huge clip, high damage) So I got one and owned them all. |

Interesting how the law can be used both as intended and also for the benefit of anyone smart enough to find a loophole.
Laws are made with good intentions (usually). This is called the spirit of the law, or the original purpose for which it was created. These days people don't look at the original purpose. Instead they look at the law as written (the letter of the law). This is why a wouldbe thief can sue you if he impails himself on one of your garden gnomes.
Laws are set in place to protect the innocent, but instead they now defend the guilty. Its turned into a war of words whether you have to define exactly what a particulat word means even though it is in common use.
Authority to copy CD's.
Permission to copy.
Allowed to copy.
Right to copy.
etc etc. They can all mean different things if you have the $$$ to buy the right lawyers. |

I will buy a CD if I like the majority of the songs, but often times I only like one or two songs on the CD. In that case, I just use Limewire. I mean, come on, I'm not going to spend $20 on one song. |

I compleatly agree with ExoStatic, it is not the only mp3 player out there. while the iPod is the most popular it has drawbacks IMO.
1.Not the best product for your earnings, IMO.
2.It is an Apple product, and I don't think much of those guys.
I will laugh when all these people have spent all this money on an iPod Mp3 player, then all of the sudden MPEG, releases the mp4 codec, and apple says, "Sorry everyone, but as mp4 replaces mp3 your current iPod will not play mp4, but you can buy a new mp4 iPod now and give us all your earning and use your old one as a super duper handy dandy paper weight." mwahahahahaha, you suckers. |

On topic...I've heard/strongly believe(too lazy to find scoure) that the RIAA is going to/scanning activity on college campus's and finding people who d/l mucic and indicting them for it. Theoritically, you could probably indict 95% of the college population, but they limit themselves to 10 students/cases per campus.(Probably to more quickly make an example over a large demographic)
I didn't believe it until someone I know personally recieved subpoena to appear in court. Crazy bastards those RIAA fcukers.
My solution: Buy a wireless card, steal net from your neighbors, and ditch your wireless card if you think the feds are on to ya(no mac addy, no proof). |
