It really depends if they are being sold for profit or if its a mod for a game based on another game.
But no usually i would say they are not. |

How would they be, its adding to the community, therefore more people would buy the game and they would get more money... mod makers are like little non-profit rats who make the makers of the game money.... (yes i know someones going to come back on me about this....) but if its based on another game.... still..... its getting both games more publicity....
But the problem comes in if you hack the acuall application for a mod |

goob, you misunderstood.
Its the problem of say adding content from a copyright holder into a game created by someone else.
There was an issue I believe last year (or maybe 2004) where Lucasarts brought their legal guns to bare after a promising mod with Star Wars content was released for another game that had nothing to do with Lucasarts.
What you've got to understand is that using ANYTHING that isn't 100% your work is going to be breaching some copyright law somewhere.
Its up to the 'community spirit' of any given company and whether or not they can be bothered if the mod makers get a letter from the legal team... Usually it boils down to whether or not the given mod is similar to a game recently or about to be released by the copyright holder. They dont want people to be able to do the same thing as their 'paid' game for free now do they? |

i can think of several skins, a bunch of maps, and one mod that violates these copyright rules. but im not going to name them so the don't draw attention.
anybody remember when somebody made an account in PC called the Borg? He dropped that like a hot potatoe after realizing there could be copywright issues, and thats a pretty minor case.
Good news is they usually don't come after those people because it bad publicity to their company ... "Company sues fans of their product" doesn't sound good for a frontline page. Or othertimes they consider it free publicity ... , if they sue, they know (most the time) that it probably won't be worth it in the long run. |

yah some companys like lucas arts gose after people but others such as nintendo and stargate based things seem to go well but I have found a mod for genrals which is star wars |

Well my Mario HUD for RF was based on the Nintendo game Super Mario Bros.
Although this may breach copyright laws as i used images and sounds extracted from their game and edited them to fit within RF i really cant see Nintendo coming after me as they are losing no money from it, and it in no way resembles the gameplay of the game it all came from.
So yes lots of mods break copyright laws, but unless the developers/publishers are going to lose money they wont do anything legal. |

Im pretty sure they wouldn't come after me for using it because i promote their products, am a stockholder, and try to help them sell more chips. now if they were to sue me, i wouldn't help them at all, infact i would probably get miffed and do the opposite.
But i dunno maybe i should change it just in case ... what do you think? |

I've heard that Nintendo will not allow you to use anything related on Mario etc when you ask them for permission. Its pretty hard to find Mario mods for any games..
The mario hud is a "small fish", they would never recognize, or go after it. It is a neat thing for RF but nothing that is too big.
I'm afraid to ask THQ to get permission for the Red Faction mod. If I get a NO, I wouldnt even get the chance to start on the mod, and I would not had the fun with it..
There is just no time or experience for starting something original.
It's all basing on unreal script experiences, nothing else. |

if you ask THQ for permission they would probably shut down the master server

if they plan on releasing a RF 3 the mod might detract from their game in the future. also its a mod for a game other than their own, so we would be using their ideas to benefit possibly a rival company. |

yes, but it MAY benafit them too, people see this and think "oh man! RF is soo cool! i want to go buy it just to see what these guys screwed up on with the mod!" 
seirously, we all know that the mod will be better than RF, but not everyone who will end up with the mod would know that... |
